PacerTerms of Use
The short version: Pacer is a nutrition and fitness tracking tool, not medical advice. Pacer Pro is an optional auto-renewable subscription billed through your Apple ID; you can manage or cancel it anytime in your Apple ID settings. By using Pacer you agree to the terms below.
1. Acceptance of these terms
By downloading, installing, or using Pacer, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the app. If you are using Pacer on behalf of someone else, or as a coach managing clients, you confirm you have the authority to accept these Terms. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Pacer.
2. Description of the service
Pacer helps you log meals, track protein and calories, monitor a calorie deficit, record fasting windows and workouts, and — for GLP-1 users — keep a medication and supplement schedule. Pacer Coach lets trainers you explicitly invite view the coaching-relevant data you share. Most features are free. Some optional features are part of Pacer Pro, described below. We may add, change, or remove features over time.
3. Pacer Pro subscription
Pacer Pro is an auto-renewable subscription that unlocks optional premium features. The following terms apply to all Pacer Pro purchases:
- Plans and pricing. Pacer Pro is offered as a monthly plan at €5.99 and a yearly plan at €59.99, each with a 1-week free trial for new subscribers. Prices are shown in your local currency and may vary by region; the price displayed on the purchase screen at the time of subscribing is the price that applies.
- Billing. Payment is charged to your Apple ID account at confirmation of purchase. If you start a free trial, billing begins when the trial ends unless you cancel beforehand.
- Auto-renewal. Your subscription automatically renews for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
- Managing and cancelling. You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID Account Settings after purchase (Settings → your name → Subscriptions on iOS, or the App Store on macOS). The in-app "Manage subscription" link opens this page for you.
- Free trial. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
4. Refunds
All purchases are processed by Apple and are subject to Apple's terms. We do not provide refunds for partial subscription periods, and cancelling stops the next renewal rather than refunding the current period. If you believe you are entitled to a refund, you may request one directly from Apple through your purchase history; refund decisions are made by Apple at its discretion.
5. Health disclaimer
Pacer is an informational and tracking tool. It is not a medical device and does not provide medical, nutritional, or professional health advice. Nothing in the app — including calorie targets, protein goals, deficit estimates, fasting guidance, and any GLP-1 or nutrition content — is a substitute for advice from a qualified physician, dietitian, or other healthcare professional. Always consult a professional before starting, changing, or stopping any diet, exercise, fasting, medication, or supplement regimen, and especially before acting on any information related to GLP-1 medications. Do not disregard or delay seeking professional advice because of something you read or calculated in Pacer. You use the app's estimates and suggestions at your own risk.
6. Acceptable use
You agree to use Pacer only for lawful, personal, and intended purposes. You will not: reverse-engineer, decompile, or tamper with the app except to the extent permitted by law; attempt to access data belonging to other users; misuse the coaching features to harass, deceive, or harm clients or trainers; or use the app in any way that violates applicable law or these Terms. Coaches are solely responsible for handling client data lawfully and only for coaching purposes, as described in our Privacy Policy.
7. Intellectual property
Pacer, including its software, design, text, graphics, logos, and the "Pacer" name, is owned by Pacer Fitness and protected by intellectual-property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, consistent with the Apple Media Services Terms and the standard Apple End User License Agreement. The data you create remains yours; you grant us no rights in your content beyond what is needed to operate the features you use.
8. Disclaimer of warranties
Pacer is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that calculations and estimates will be accurate for your individual circumstances. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, Pacer Fitness and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health outcomes, or profits, arising out of or relating to your use of (or inability to use) Pacer — even if advised of the possibility. To the extent liability cannot be excluded, it is limited to the amount you paid us for the subscription in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Changes to these terms
We may update these Terms as Pacer evolves. When we do, we'll revise the "Last updated" date above and, for material changes, give notice through the app or website. Continuing to use Pacer after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the operator's jurisdiction within the European Union, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of its competent courts. If you are a consumer, you also retain the protections of any mandatory consumer-protection laws of your country of residence.
